Terms of Use

Welcome to Transfrly ("we," "our," or "us"). By accessing or using the Transfrly website, applications, or services (the "Service"), you agree to these Terms of Use ("Terms"). If you do not agree to these Terms, you must not use the Service.

Transfrly® is a private, invite-only communication platform designed around ephemeral conversations. Your Connection Handle and Revoke Token allow you to communicate with people you choose, while conversations remain temporary by design. Except for the limited functionality required to operate the Service, Transfrly does not archive conversations or maintain message history.

You are responsible for using the Service lawfully and for safeguarding your Revoke Token, which cannot be recovered if lost.

Transfrly enables private communication between trusted people through Connection Handles and invite-only conversations. Users communicate using text, files, voice notes, audio, video, and other supported features. The Service is designed around ephemeral communication. Once a conversation has ended or content has expired, it is permanently removed and cannot be recovered. Transfrly does not provide message history, archives, or conversation recovery.

Certain optional features, including temporary unread message retention for eligible users, operate only for the limited time necessary to deliver the Service and are automatically removed after their expiration period.

Transfrly Mail is an integrated communication feature within the Transfrly ecosystem. Each Connection Handle is assigned a corresponding @transfrly.io address, allowing users to receive messages without creating a traditional email account or permanent mailbox. Transfrly Mail is designed for temporary communication, not long-term storage. Messages are retained only for the limited time necessary to facilitate delivery and access. Once delivered, expired, or after a maximum of 24 hours, all message content is permanently deleted and cannot be recovered.

Transfrly Mail does not provide permanent inboxes, message archives, backups, or retrieval services. It is not intended for communications requiring long-term retention, legal record-keeping, account recovery, verification, or permanent storage. You are solely responsible for the content you send or receive through Transfrly Mail and for safeguarding your Connection Handle and Revoke Token. To maintain the security, integrity, and availability of the Service, Transfrly may apply reasonable limits, rate controls, or temporary restrictions where necessary.

Transfrly monitors the operation, performance, and security of the Service, including abuse prevention. We do not monitor message content as part of normal operation and do not retain messages beyond the temporary processing period required to provide the Service.

You must be at least 16 years old, or the minimum age required in your jurisdiction to consent to online services, to use Transfrly. By using the Service, you represent that you meet this requirement.

By accessing or using Transfrly, you agree to:

• Use the Service lawfully. Use Transfrly only in compliance with all applicable laws, regulations, and the rights of others.
• Share only authorized content. You may transmit only content that you own or have the legal right or authorization to share.
• Respect others. Do not use the Service to harass, threaten, impersonate, defraud, or otherwise interfere with the privacy, safety, or lawful rights of any person.
• Maintain the security of your identity. You are responsible for safeguarding your Connection Handle, Revoke Token, device, and any access to the Service initiated from them.
• Manage your communications responsibly. You are responsible for the individuals you choose to connect with, invite, and communicate with through Transfrly, as well as for the content you transmit using the Service.

Transfrly provides the platform and communication infrastructure. You remain solely responsible for your conduct, your communications, and your use of the Service.

Transfrly may not be used for any unlawful, harmful, fraudulent, or abusive purpose.

You may not:

• Violate any applicable law or regulation.
• Harass, threaten, stalk, impersonate, defraud, or abuse another person.
• Create, transmit, or facilitate illegal, obscene, pornographic, exploitative, hateful, extremist, or violent content.
• Exploit, solicit, groom, or otherwise endanger minors.
• Attempt to access, disrupt, interfere with, or compromise the security, availability, or integrity of the Service.
• Use bots, crawlers, scrapers, automated tools, or similar technologies to misuse, overload, or extract data from the Service.

Any use of Transfrly to exploit or endanger minors, including the creation, solicitation, or distribution of child sexual abuse material ("CSAM"), is strictly prohibited. Transfrly reserves the right to comply with applicable laws and lawful requests from competent authorities where required.

Privacy is a design principle of Transfrly. It does not exempt any user from complying with applicable laws.

Transfrly is designed to minimize data persistence and is not intended to function as a platform for user identification or long-term communication history. As a result, our ability to investigate or respond to misuse may be inherently limited.

To protect the Service, its users, and comply with applicable law, Transfrly may implement reasonable temporary technical safeguards where appropriate. Any such measures are limited to operational purposes and do not modify the fundamental privacy architecture of the Service.

Reports of misuse, harassment, or unlawful activity may be submitted to support@transfrly.com . We reserve the right to take any action we consider appropriate to protect the Service, its users, or to comply with applicable law.

Extend Control is an optional, twenty-eight (28)-day upgrade that provides access to additional premium features while preserving Transfrly's core privacy architecture.

Certain premium features may allow communications to remain temporarily available for operational continuity for up to twenty-four (24) hours. No communication is intended to persist beyond this period and, once deleted, cannot be recovered.

Activation & Finality. Extend Control is available immediately upon successful payment. Because access is provided instantly and is time-limited, all purchases are final and non-refundable, except where required by applicable law.

Transfrly is designed to minimize data persistence. Communications are temporary and handled in accordance with the Service's data lifecycle. Except where a feature expressly provides otherwise, communications are not intended to persist and, once removed, cannot be recovered.

Payments for optional premium features are processed exclusively by Stripe. Transfrly does not receive or store payment card information.

Transfrly uses Plausible Analytics to measure anonymous, aggregate usage. Plausible is cookie-free, GDPR-compliant, and does not identify individual users.

Transfrly uses industry-standard encryption and reasonable technical, administrative, and organizational safeguards designed to protect the security, integrity, and availability of the Service. While we continuously work to maintain a secure platform, no method of electronic communication, transmission, or storage can be guaranteed to be completely secure.

By using Transfrly, you acknowledge these inherent risks and agree to use the Service in accordance with these Terms.

Transfrly is provided on an "as is" and "subject to availability" basis. We may modify, update, suspend, or discontinue any part of the Service at any time, with or without notice.

To the fullest extent permitted by applicable law, Transfrly is not liable for any interruption, unavailability, modification, or discontinuation of the Service, or for any resulting loss or inconvenience.

You agree to indemnify, defend, and hold harmless Transfrly, its affiliates, owners, officers, directors, employees, contractors, licensors, and service providers from and against any claims, liabilities, damages, losses, judgments, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your content, your violation of these Terms, or your violation of any applicable law or the rights of any third party.

To the fullest extent permitted by applicable law, the Service is provided "as is" and "as available," without warranties of any kind, whether express or implied.

To the fullest extent permitted by applicable law, Transfrly, its affiliates, owners, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, communications, profits, revenue, goodwill, business opportunity, or use, arising out of or relating to your access to or use of the Service, even if advised of the possibility of such damages.

Transfrly is designed to minimize data persistence. We may comply with applicable laws, valid legal process, and lawful requests from competent authorities to the extent required by law and consistent with the architecture of the Service.

These Terms are governed by the laws of your country of residence, excluding its conflict-of-law principles. Any dispute arising out of or relating to the Service shall be subject to the exclusive jurisdiction of the competent courts within that jurisdiction.

The Transfrly Service, including its trademarks, branding, logos, software, user interface, design, content, and underlying technology, is the exclusive property of Transfrly or its licensors and is protected by applicable trademark, copyright, and other intellectual property laws.

Except as expressly permitted by these Terms or applicable law, you may not copy, reproduce, modify, distribute, reverse engineer, decompile, create derivative works from, or otherwise exploit any part of the Service without Transfrly's prior written permission.

Transfrly is not intended for emergency communications and must not be relied upon to contact emergency services, law enforcement, medical providers, or other emergency responders. If you require emergency assistance, contact your local emergency services immediately.

We may modify these Terms from time to time. Any changes become effective upon posting unless otherwise stated. By continuing to access or use the Service after updated Terms become effective, you agree to be bound by the revised Terms.

• Termination. Transfrly may suspend or terminate access to the Service where necessary to protect the Service, its users, or comply with applicable law.
• Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain effective.
• Entire Agreement. These Terms and our Privacy Policy represent the complete agreement between you and Transfrly regarding the Service.
• No Waiver. Failure to enforce any provision does not waive our right to enforce it in the future.
• Assignment. You may not transfer these Terms without consent. Transfrly may assign these Terms as part of a business transfer, merger, acquisition, or other lawful transaction.
